City Council Considers Complaint Against Green

   At the February 7, 2012 meeting the Duncanville City Council reviewed and discussed a complaint filed by Duncanville resident Patricia Ebert against Mayor David Green claiming that entered into an agreement despite a vote in opposition that gave the project developer Monte Anderson a thirty day notice of default for the project that is partially funded by the Duncanville Economic Development Corporation.
    The new City Attorney, Julie Fort with McKamie Kruger, reviewed the Code of Ethics complaint, reviewed the six prongs the complaint needed for legal and factual sufficiency. Her opinion is that Green signed the contract with the advice of the prior city attorney, Bob Hagar with Nichols, Jackson Dillard, Hager & Smith. It appeared by her comments that the new City Attorney would have given different advice.
    In the complaint Ebert stated that Green willfully and knowingly approved and signed a contract that he did not have permission to sign that extended a contract for the agreement with Monte Anderson. A notice of default was to be sent to Anderson instead, Green entered into a new contract to change and give more time to Anderson.
Green’s rationale, the Duncanville Economic Development Corporation voted to approve the contract despite the opposition of the Council and that he, by his position as Mayor, was able to sign a contract on their behalf. The new contract gave Anderson an extension to pull a building permit.
    Bob Hagar, former City Attorney, stated that Green’s signature only indicated the Council’s prior support of the project. When Jameson asked Hagar if he had been given direction to develop a new contract he flatly told her no. Green suggested that wasn’t the case.
In sum, Jameson put it plainly, “Green got bad legal advice”. The Council voted unanimously to end the complaint.
