I am filing a formal complaint against Councilmember Grady W. Smithey, Jr. for violating Section 2-54 # 14 of the City of Duncanville's Code of Ethics for Elected and Appointed Officers, "Engaging in any conduct damaging to the city." This violation is documented in the attached Gty of Duncanville Mayor & Council Members Travel Expense Report dated May 3, 2006, received June 12, 2006 for travel dated June 8-9, 2006.
Mr. Smithey represented himself as a City Council Member requesting reimbursement for travel expenses after he lost the 2006 election and the new Council Member had already been sworn into office. Please see the attached minutes from the City Council Regular Meeting on June 6, 2006 for validation of this fact.
This falsifying of an official document also violates The State of Texas Integrity Penal Code (Public integrity Violation -Theft -Falsifying a Governmental Record Penal Code Title 7 & 8.

JUNE 6,2006
A regular meeting of the City Council was held on Tuesday, June 6,2006 at 7:03 p.m, with a quorum present, to wit:
David Green Mayor
Dorothy Burton - Councilmember
Ken Weaver - Councilmember
Scott Cannon - Mayor Pro Tern
Anthony Skinner - Councilmember
Grady Smithey - Councilmember
Johnette Jameson - Councilmember
The Invocation was provided by former Mayor Glenn Repp. The Pledge of Allegiance was led by City Secretary Jeanne Fralicks.
Mayor Green and the City Council presented a plaque to Grady Smithey for dedicated service and significant contributions as District 4 Councilmember (1984-1994 and 1998-2006) and Mayor Pro Tern (1986-1990,2001-2002, and 2003-2004). An additional presentation was made by Mayor Pro Tern Cannon. Councilmember Smithey extended thanks to the City Council and residents for the opportunity to serve as District 4 Councilmember. He also commented on his commitment to transportation issues and extended thanks to his wife and son.
Item l. City Secretary Jeanne Fralick administered the Oath of Office and presented a Certificate Election to Deborah Hodge. After extending thanks to residents and family for their support, Mrs. Hodge took her seat as District 4 Councilmember.
